Terms of Service & Sale

These Terms are a binding electronic agreement and, for orders accepted by Bimbiamore LLC, the terms of sale (public contractual offer) for Tap4Go products and services.

1. Provider and scope

Tap4Go is operated by Bimbiamore LLC, 30N South Gould Street, Ste N, Sheridan, Wyoming 82801, USA (“Bimbiamore”, “Tap4Go”, “we”). Contact: info@tap4go.com. These Terms govern tap4go.com, the Tap4Go account area, hosted profile pages, NFC products, related software, support, and any order that incorporates these Terms.

2. Acceptance, age and authority

You accept these Terms by checking the acceptance box, creating or activating an account, publishing a page, placing an order, or using the Services after notice of these Terms. You must be at least 18 and legally capable of contracting. If you act for an organisation, you represent that you can bind it. Minors may not create accounts, publish business cards or submit contact requests.

3. Service

Tap4Go lets authorised users activate an NFC identifier, maintain a hosted business-card page, publish professional contact information, share a vCard, collect contact requests, and view privacy-preserving aggregate interaction statistics. Optional Google Analytics remains consent-based. Features may differ by product, plan, location or device. The NFC item normally opens a URL; no guarantee is made that every device, operating system, reader configuration, network, browser or third-party app will support NFC or every linked feature.

4. Orders, contract formation and prices

Product pages and advertisements invite you to place an order. By pressing the final order button you submit a binding offer to purchase at the displayed total, including disclosed taxes, shipping and fees. We accept the offer by sending an acceptance or dispatch confirmation, or by performing the service. An automated receipt alone does not accept an order. We may reject or cancel an order before acceptance for stock, pricing, fraud, sanctions, technical or legal reasons and will refund amounts collected for the cancelled part. Obvious errors may be corrected before acceptance. Payment is processed by the payment provider shown at checkout; Tap4Go does not receive or store the full payment-card number.

5. Delivery, title and risk

Delivery dates are estimates unless expressly guaranteed. You must provide an accurate deliverable address and inspect the shipment promptly. Title and risk pass as required by mandatory law; for business customers, risk passes on delivery to the carrier unless the order states otherwise. Customs duties and import charges are the recipient’s responsibility unless included at checkout.

6. Returns, refunds and statutory rights

The return policy displayed during checkout applies in addition to non-waivable consumer rights. Personalised or activated goods may be excluded from discretionary returns where lawful, but this does not limit rights for defective, misdescribed or non-conforming goods. EEA/UK consumers retain any mandatory withdrawal, conformity, repair, replacement, price-reduction and refund rights. 7. Accounts and security

You must provide an email address you control, maintain accurate information, keep credentials confidential and notify us promptly of suspected compromise. Accounts are individual unless an organisational plan says otherwise. You are responsible for authorised activity and for ending access of former personnel. We may require verification, reset credentials, revoke sessions or suspend access to protect users or the Service.

8. User content and public pages

You retain ownership of content you submit. You grant Bimbiamore a worldwide, non-exclusive, royalty-free licence to host, reproduce, format, transmit, display, back up and otherwise process that content only to operate, secure and improve the Service and comply with law. A published page is intentionally public and may be copied, indexed, photographed or shared by others. Do not publish anything you cannot lawfully make public.

You are responsible for the accuracy and legality of your business-card content and for all notices, lawful bases, permissions and consents concerning other people. Tap4Go business cards are not designed for health, child, government-identity or other sensitive data; do not enter those categories. You must honour valid correction, withdrawal and deletion requests without delay.

9. Contact collection and controller responsibilities

When a page owner enables contact collection, that owner determines why and how the submitted contact details are used and is normally the controller/business for those leads; Tap4Go provides storage and transmission as a processor/service provider under the DPA. Page owners may use a lead only to answer the request unless they independently obtain another lawful basis. They must not add the sender to marketing lists without the consent required by applicable law.

10. Acceptable use

You must comply with the Acceptable Use Policy. You may not abuse, probe, disrupt or bypass the Service; infringe rights; impersonate others; distribute malware or spam; publish unlawful, deceptive or harmful material; or process personal data without a lawful basis. We may remove or restrict content and preserve evidence where reasonably necessary.

11. Intellectual property

The Service, software, design, Tap4Go marks and non-user content are owned by Bimbiamore or its licensors. Subject to these Terms, we grant you a limited, revocable, non-transferable right to use the Service for its intended purpose. No source-code, trademark, resale or derivative-work rights are granted except where mandatory law permits otherwise.

12. Third-party services

Pages may link to or embed third-party services such as Stripe, Google Maps, YouTube, messaging networks and social platforms. Those services have their own terms and privacy practices. We do not control third-party availability, content or decisions. Optional Google Analytics and external media are disabled until the applicable cookie preference permits them. First-party aggregate interaction counters do not load a third party or use an analytics cookie.

13. Availability, changes and termination

We may maintain, improve, replace or discontinue features. We will use reasonable efforts to give advance notice of a material adverse change when practicable. You may stop using the Service and request account deletion. We may suspend or terminate access for breach, security risk, non-payment, unlawful conduct or legal requirement. Provisions that by nature should survive will survive, including payment, licence, confidentiality, disclaimers, liability and dispute terms.

14. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. We do not disclaim any warranty or consumer guarantee that cannot lawfully be excluded.

15. Limitation of liability

To the maximum extent permitted by law, Bimbiamore and its affiliates will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss, lost profits, lost business, lost data or loss caused by reliance on public business-card information. Aggregate liability arising from the Service will not exceed the greater of USD 100 or the amount you paid to Bimbiamore for the affected product or Service during the 12 months before the event. These limits do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, data-protection liability that cannot be limited, or other liability that mandatory law forbids us to limit.

16. Indemnity for business users

If you use the Service for business, you will defend and indemnify Bimbiamore against third-party claims arising from your unlawful content, your instructions, your breach of another person’s privacy or intellectual-property rights, or your material breach of these Terms, except to the extent caused by Bimbiamore. This clause does not apply to consumers.

17. Governing law and disputes

Wyoming law governs, without regard to conflict rules, and state and federal courts serving Sheridan County, Wyoming have jurisdiction. If you are a consumer, this choice does not deprive you of mandatory protections or access to courts available under the law of your habitual residence. Before filing a claim, the parties should send a written description and allow 30 days for a good-faith resolution, unless urgent relief or a statutory deadline requires earlier action.

18. Changes and general terms

We may update these Terms prospectively. Material changes will be notified through the Service or by email when required. Continued use after the effective date constitutes acceptance only where lawful; otherwise we will seek renewed acceptance. These Terms, incorporated policies and an accepted order form the entire agreement. Invalid provisions will be narrowed or severed. Failure to enforce is not a waiver. You may not assign the agreement without consent; we may assign it in a merger, reorganisation or sale while preserving applicable rights.
